It's illegal in most states here, as well. "Hidden cameras" need to get the participants written agreement to "star" in the video.
I know, I know, I just took all the fun out of it.
I also think that "hidden camera" doesn't necessarily mean "not known about by the subject". Quite often I think it just states that it was a hidden camera as the idea of watching someone without his/her knowledge is somehow more titillating.
It's also possible that in some countries the law might be a bit more hazy as well. Certainly in most countries it is not legal. Just look at the Erin Andrews case as an example.
